By clicking on the JOIN button you are agreeing to be a Member of Club Boomerang in accordance with the following terms.
2. Definitions- Card means the Club Boomerang card issued to Members
- Credit Card means any credit card issued by any bank in the countries in which Club Boomerang operates, including but not limited to VISA, American Express, MasterCard and BankCard
- Member means an eligible person who has joined Club Boomerang and paid their joining fee in accordance with the Terms and Conditions.
- Member ID means the individual 8 digit number which is issued to all Members
- Non-excludable Rights means any rights or remedies that you may have which are referred to in Disclaimer and limitation of liability.
- Password means the word which is set by each Member at the time of joining and which is required ongoing to log onto the Club Boomerang website
- Partner means any entity which is accessed via the Club Boomerang website where Members can earn or redeem Club Boomerang Real Rewards Points.
- Program Partner means participating Travel Wholesalers. This entity will offer an allocated number of Reward Points when there service is utilized
- Person means an individual of at least 18 years of age
- Points Bank means a record established in the name of the Member for the purpose of accruing Club Boomerang Rewards Points and determining when the Member becomes entitled to claim a Club Boomerang Award.
- Schedule of Fees means the schedule of fees that relate to membership and other costs in Club Boomerang as amended from time to time.
- Terms and Conditions means these terms and conditions as amended from time to time
- Club Boomerang Award means any Club Boomerang or Partner products or services which have been nominated by Club Boomerang as eligible to be obtained by a Member redeeming Rewards points through Club Boomerang including but not limited to, gift vouchers, merchandise, travel, travel vouchers, or other benefit.
- Points Statement means a summary showing the balance of Club Boomerang Rewards points as featured in the Member’s Points Bank including points earned and redeemed.
- Club Boomerang means this Awards program, owned and operated by TripleAClub Pty Ltd ABN 65 099 692 903.
- Club Boomerang Redemption Centre means the area established by TripleAClub on the website where Members can choose their Awards
- Reward Points means points earned as a result of bookings made from affiliate partners, or purchases made via the Club Boomerang shopping Mall. Each Reward point having a value of 1 cent (AUD)
- Voucher means a document which may be obtained by a Member earning or redeeming points and which is issued on behalf of a Partner and may be exchanged for a Partners' product or service
- We means the Real Rewards
- You Means any member of the Club Boomerang program
3. Acknowledgments and Acceptance
3.01 By clicking on the "JOIN" button, you acknowledge that you have read and agree to be bound by the Club Boomerang Terms and Conditions.
3.02 We reserve the right to amend the Club Boomerang Terms and Conditions in whole or in part at any time with or without prior notice to any Member. Members may be notified of any changes to the Club Boomerang Terms and Conditions via the Club Boomerang web site or in such other manner as we determine.
3.03 You acknowledge that full access to the Club Boomerang web site is partly dependant on the browser installed on your computer.
4.01 Membership is subject to fees: there is a Joining Fee which can be found on the Schedule of Fees
4.02 You may join the Club Boomerang on the Club Boomerang website. You are not a Member until you have joined by completing certain information and clicking on the JOIN button to signify your acceptance of these Terms & Conditions. Only Members may earn and redeem Club Boomerang Rewards points.
4.03 Your membership in Club Boomerang is non-transferable.
4.04 Each Member must have at least one unique email address.
4.05 You agree to provide only true and complete information to Club Boomerang
4.06 You agree to provide your email address and personal profile to Club Boomerang upon joining and to notify Club Boomerang immediately of any change to that information. Updates to Members personal profile can be made within the My Membership section of the Club Boomerang website
4.07 You agree not to attempt to accrue or redeem Club Boomerang Rewards points in a manner inconsistent with:• The Club Boomerang Terms and Conditions; The rules of any promotions conducted under the auspices of Club Boomerang; or The intent of the Club Boomerang Terms and Conditions.
4.08 We reserve the right to limit the number of Members of Club Boomerang at any time.
4.09 We reserve the right to refuse Membership to the Club Boomerang at any time.
4.10 One step in the process of activating your Membership in Club Boomerang is to key in your Member ID and Password. You will be asked to key in these details each time you seek to earn Club Boomerang Rewards points, review your Points Bank, or to redeem or transfer points. If the Member ID and Password is not accepted, then your request will be denied. We are entitled to act on instructions received from you or someone purporting to be you if the Member ID and Password is accepted.
4.11 You should not divulge your Password or Member ID to anyone. We will not be held responsible for transactions, which have taken place without the authority of the Member
4.12 If you believe that another person has become aware of the details that might allow him or her to transact with your Club Boomerang Rewards points without your authority, you must change your password. Changes to Passwords can be made within the My Membership section of the Club Boomerang website
5. Earning Club Boomerang Rewards points
5.01 You may earn Club Boomerang Reward Points by:• Joining the Club Boomerang;• Booking Club Boomerang Affiliate Partner (supplier) products;• Purchasing goods from Bonus Partner web sites accessed through the Club Boomerang website;• Complying with the terms of other offers from Club Boomerang or Partners through the Club Boomerang website.
5.02 Club Boomerang Reward Points you earn will be credited to the Points Bank corresponding to your Member ID.
5.03 We reserve the right at any time to establish additional means of accruing Club Boomerang Reward Points or to delete any or all of the means currently recognised.
5.04 Club Boomerang Real Reward Points will normally be credited to your Points Bank on the fifteenth day of the month following the; 1. departure of the booking made with Affiliate partners; or 2. purchase transaction through the Club Boomerang Shopping Mall with the Bonus Partners.
5.05 We reserve the right to limit your opportunities to earn Club Boomerang Reward Points while your Membership is deemed inactive. See also clause 9.02.
5.06 We will use our reasonable endeavours to send you a monthly correspondence advising your Club Boomerang Reward Points balance and other information relevant to your Membership, including ways in which Club Boomerang Reward Points may be redeemed, but expressly disclaim any liability for failure to do so. All active Club Boomerang Members will receive this correspondence.
5.07 If there are any credits posted to your Credit Card by a Partner arising from returned goods or services the purchases of which resulted in you earning Club Boomerang Reward Points, adjustments will be made by Club Boomerang to the Club Boomerang Reward Points earned in your Points Bank.
5.08 Should any default be made by a Partner then we shall be entitled to deduct the corresponding earned Club Boomerang Reward Points from your Points Bank.
5.09 We will not be held responsible for any failure in the reporting of accrued Club Boomerang Reward Points from any Partner.
5.10 It is your responsibility to regularly check to ensure that Club Boomerang Reward Points have been properly credited to your Points Bank. If they are not, please follow the procedure detailed in the Club Boomerang website FAQ’s. The Club Boomerang must receive all transaction queries within 60 days of the queried transaction. Corrective action cannot be taken after that time.
5.11 We reserve the right to send you messages from time to time. Such messages may include Club Boomerang updates, redemption offers, flash bulletins, order confirmations, administrative announcements and special requests. Club Boomerang will also send you messages/correspondence on behalf of Affiliate Partners throughout the year.
5.12 We are under no obligation to provide you with any particular number of Club Boomerang Reward Points earning opportunities or to send you correspondence.
5.13 Club Boomerang Reward Points accrued by you are non-transferable, whether by operation of law or otherwise, either to any person or entity, any other loyalty program or any other Member’s Points Bank.
5.14 14 Neither Club Boomerang Reward Points nor Club Boomerang Awards may be bartered or sold, bequeathed or inherited.
5.15 Club Boomerang Reward Points have a value of 1 cent each while a Member remains a Member of Club Boomerang, the value of which can be realised only by redemption for a Club Boomerang Award or by Club Boomerang ceasing to trade and in accordance with the Trust Deed.
5.16 To credit you with Club Boomerang Reward Points, we need to track your purchases performed on the web sites of Partners. When we forward a member to a Partner, we also forward that Member’s unique identification number as a "URL parameter".
6. Redeeming Club Boomerang Reward Points
6.01 Club Boomerang Reward Points can be redeemed for a wide range of awards as detailed on the Club Boomerang website at the time of redemption. Club Boomerang is not responsible for changes to, or discontinuance of, any award.
6.02 Club Boomerang Awards can be obtained by the redemption of Club Boomerang Reward Points.
6.03 Club Boomerang Reward Points can also be donated to the chosen Club Boomerang charities as part of the Club Boomerang Redemption Centre
6.04 Reward Points cannot be redeemed for cash
6.05 To redeem Club Boomerang Reward Points for travel related awards subject to availability, you must make a Reservation Request at the Redemption Centre. Reservation Requests may be initiated only while logged into the Club Boomerang web site, using your Member ID and Password. Once a Reservation Request has been made, changes and cancellations will be subject to the charges detailed in the Schedule of Fees and Charges or as advised at the time of your Reservation Request. You acknowledge and agree that Club Boomerang may capture demographic information as needed for fulfilling your redemption request.
6.06 Travel and Experience related awards are subject to booking terms and conditions as detailed on the Club Boomerang website
6.07 Unredeemed Club Boomerang Reward Points do not expire whilst your Membership remains current. If your Membership is inactive for a period of 6 months, or you cancel your Membership your Club Boomerang Reward Points will expire.
6.08 Club Boomerang Reward Points will be allocated from your Points Bank and reserved once Club Boomerang has received the Request of redemption.
6.09 All Club Boomerang Awards are subject to availability and restrictions may apply.
6.10 The time taken to supply an award will vary. Club Boomerang shall not be liable for any delay to supply the award.
6.11 Upon Club Boomerang awards being supplied to you (whether by Club Boomerang or Partner), you release Club Boomerang from any and all liability in respect of that redemption of Club Boomerang Reward Points or use of such award.
6.12 You must use Vouchers before the expiry date shown on the voucher
6.13 Club Boomerang is not responsible for lost, stolen, expired or otherwise destroyed awards or Vouchers.
6.14 Once redeemed Club Boomerang Reward Points will not be reinstated to your Points Bank.
6.15 Awards are not exchangeable for Club Boomerang Reward Points or other Club Boomerang awards, nor are they refundable, replaceable or transferable for cash or credit under any circumstances.
6.16 Once a Request has been made, if changes or amendments are allowed, Cancellation and Amendment fees will be charged. Refer to the Schedule of Fees and Charges
6.17 If you are an Australian taxpayer, Club Boomerang Awards may be subject to personal income or other tax assessment. You are advised to check with your accountant or tax adviser for further information.
6.18 It is the responsibility of each Member to keep track of any and all redemptions made against their account.
6.19 Offers are subject to change and are available while stocks last. Goods may not be returned or exchanged unless required by law. All merchandise and vouchers delivery is normally within 25 working days, but delays may occur. Offers in this website are arranged and offered solely by Club Boomerang. 7.01 We undertake to use our reasonable endeavours to maintain the privacy of your personal information. Read about our commitment to safeguarding your privacy and our credit card security guarantee in our Privacy Policy and Security Policy
7.02 You acknowledge and agree that Club Boomerang and our owners and agents (including independent auditors or consultants) may use information supplied by you including, without limitation, your name, address, email address, other demographic information, and also information about your Club Boomerang Reward Points earning and redemption transactions, for administrative, planning, research and marketing purposes, and to perform services relating to Club Boomerang including the customer service operations of the Club Boomerang Redemption Centre.
7.03 You authorise Club Boomerang to disclose to third parties including Partners, information you have provided or information we have about your Points Bank: • To a government agency to comply with a court order or request where required or authorised by or under law; • Where it is necessary for the redemption or transfer of Club Boomerang Reward Points; • When you are participating in some promotion (e.g. a competition) and authorise its disclosure; or • If investigation of disputed transactions requires it.
8. Disclaimer and Limitation of Liability
8.01 You agree that participation in Club Boomerang is at your sole risk.
8.02 We do not exclude any rights or remedies which you may have pursuant to consumer protection laws in Australia and other countries in which Club Boomerang operates but we exclude all other conditions and warranties implied by custom, law, statute or otherwise.
8.03 Subject to the Non-excludable Rights: 1) Club Boomerang and all services offered therein are provided on a strictly "as is" and "as available" basis without warranties of any kind either express or implied; 2) we expressly disclaim all warranties of any kind and make no warranties either express or implied including, but not limited to, warranties: • with regard to any products, services or awards you obtain through Club Boomerang, Club Boomerang Reward Points, Providers, advertisers or other parties; • that Club Boomerang will meet your requirements; • that Club Boomerang will be uninterrupted, timely, or error-free; • about the results that you may obtain from the use of Club Boomerang; • about the accuracy or reliability of any information obtained through Club Boomerang; • of Merchantability or fitness for a particular purpose of Club Boomerang or any products, goods or services you obtain through Club Boomerang; and • created by advice or information, whether oral or written, obtained by Members from Club Boomerang or through Club Boomerang unless expressly made therein.
8.04 In addition, although we intend to take reasonable steps to prevent the introduction of viruses or other destructive materials to the Club Boomerang web site, we do not warrant, guarantee or make any representations that the Club Boomerang web site is free of destructive materials.
8.05 We shall not be liable or responsible for any guarantees, warranties and representations offered by Partners, advertisers, and manufacturers of merchandise or supplier of services through the Club Boomerang website.
8.06 To the extent permitted by law, we are under no circumstances liable for any loss suffered or sustained, to person or property including, but not limited to, direct, indirect, incidental, special or consequential damages or losses whatsoever that result from: • Any act or omission, deliberate or negligent by Club Boomerang or our servants or agents or Partners in connection with Club Boomerang; • Participation or inability to participate in Club Boomerang; • The supply of a Clu Boomerang award or from the theft or destruction of a Club Boomerang award; . Use or access of, or any inability to use or access the Club Boomerang web site; or • Reliance on or use of information, services or merchandise provided on or through Club Boomerang. • Misuse of Members ID or Password
8.07 To the fullest extent permitted by law, our liability for breach of any implied warranty or condition which cannot be excluded is limited at our option to the following:• in the case of services supplied or offered by Club Boomerang: • The supply of the services again; or • The payment of the cost of having services supplied again;
8.08 We are not responsible for changes to, or discontinuance of, any promotion, any withdrawal by a Partner from Club Boomerang, or for any effect on accrual of Club Boomerang Reward Points caused by such changes, discontinuance, or withdrawal.
8.09 We are not responsible for failing to notify you where such failure is caused by an error in your email program, an inaccurate email address, or your failure to check your email or the Club Boomerang web site. Any notices or correspondence sent by Club Boomerang will be deemed to have been received by you if sent to the address provided by you pursuant to clause 4.06.
8.10 We are not responsible for any error, omission, interruption, deletion or delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of the Club Boomerang web site or your Points Bank or any messages sent by you to Club Boomerang or received by you from Club Boomerang.
8.11 We are not responsible for any problems or technical malfunction of any telephone network or lines, traffic congestion on the Internet, computer systems, servers or providers, computer equipment and software or failure of any email to be received by you or Club Boomerang as a result of such problems.
8.12 You acknowledge and agree that we neither endorse the contents of messages, Partner advertisements or Internet sites operated by Partners which are accessed via the Club Boomerang website referral buttons or other pointers, nor assume responsibility or liability for the content and accuracy of material contained therein, or any infringement of Partner intellectual property rights arising there from, or any fraud or other crime facilitated thereby.
8.13 Your correspondence with or participation in promotions by Club Boomerang advertisers and Partners are solely between you and the other party. We assume no liability, obligation or responsibility for any part of any such correspondence, transaction or promotion.
9.01 You may cease to be a Member of the Club Boomerang at any time by cancelling your Membership on the Club Boomerang website. Your membership in the Club Boomerang will be cancelled immediately on receipt of that notice by Club Boomerang and Club Boomerang Reward Points will be made invalid. No refund will be made in respect of unused Club Boomerang Membership.
9.02 We may at any time and at our sole determination terminate your membership in Club Boomerang: • For failure to comply with the Club Boomerang Terms and Conditions; • For abuse or violation or for suspected abuse or violation of the Club Boomerang Terms and Conditions; • For providing information that is misleading or deceptive to Club Boomerang or Partners; • For failing to notify Club Boomerang of email address or profile changes as soon as practicable after the change; or • Upon your death.
9.03 Termination of your membership by Club Boomerang pursuant to clause 9.02 is effective upon notice of such termination being sent by Club Boomerang to the address provided by you pursuant to clause 4.06.
9.04 Upon termination of your membership any unredeemed Club Boomerang Reward Points earned by you will be cancelled and we will take reasonable steps to destroy or permanently de-identify information about your membership in Club Boomerang after six months of the date of termination of your Membership.
9.05 Upon termination of your Membership any unredeemed Club Boomerang Reward Points held in your Points Bank will cease to have any monetary value and you will have no further claim against these Club Boomerang Reward Points.
10.01 All questions or disputes regarding Club Boomerang including, without limitation, questions or disputes regarding eligibility for Club Boomerang or the eligibility of Club Boomerang Reward Points for accrual or redemption, must be submitted in writing (accompanied by a legible copy of relevant sales receipts or other material information) within 60 days of the transaction in question or dispute, to the Club Boomerang. Any such dispute shall be resolved by Club Boomerang at our sole discretion. All interpretations of the Club Boomerang Terms and Conditions shall be at our sole discretion. In the event that Club Boomerang makes an error, such error shall not constitute a breach of any contract, and your remedy shall be limited to enrolment in Club Boomerang or the credit of the disputed Club Boomerang Reward Points to your Points Bank.
10.02 We reserve the right to adjust a Member’s Points Bank in whole or part at any time as a result of goods returned, a dispute or fraud, without notice even though such change affects Club Boomerang Reward Points already accrued.
10.03 Any dispute concerning goods or services received as a Club Boomerang Award shall be settled between you and the Partner who supplied the goods or services. We will bear no responsibility for resolving such disputes or for the dispute itself.
11.01 The Club Boomerang Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia.
11.02 You are personally responsible for any taxation or similar liability or duty arising from your participation in Club Boomerang or the redemption of Club Boomerang Reward Points.
11.03 Our failure to enforce a particular term or condition does not constitute a waiver of that term or condition by Club Boomerang
11.04 If any term or provision of these Terms and Conditions shall, by any extent, be determined to be invalid or unenforceable by a court or body of competent jurisdiction, the remainder of these Terms and Conditions shall not be affected thereby, and each term and provision of these Terms and Conditions shall be valid and enforceable to fullest extent permitted by law
